Terms of sale
The terms for buying an A11yMate licence, written to be read. Your legal rights as a customer are not affected by anything here.
Who we are
A11yMate is made by OakFox Limited, a company registered in England and Wales (number 17118912). Registered office: Martland Mill, Oakfox, Mart Lane, Burscough, L40 0SD. OakFox Limited is not VAT registered.
You can reach us at hello@a11ymate.co.uk.
Who you pay
Freemius runs our checkout as merchant of record. That means it sells the licence to you on our behalf, takes the payment, charges the right tax for where you are and sends your receipt. Its buyer terms cover the payment itself. These terms cover A11yMate.
What you are buying
A licence for one year of A11yMate Pro or Agency, as described on the pricing page when you buy:
- Pro covers one website. Agency covers up to 25.
- For that year you get the paid features, updates and email support.
The free version is free on WordPress.org and needs no licence. A11yMate's code is open source under the GPL. The licence terms explain what that means and what a licence key adds.
Prices and tax
Prices are in pounds sterling and are shown on the pricing page before VAT. Freemius adds VAT or sales tax for where you are at checkout and shows the total before you pay. For example, a UK consumer pays £106.80 a year for Pro, which is £89 plus 20% VAT. Businesses with a valid VAT number may be charged without VAT where the law allows.
If we change our prices, the year you have already paid for is not affected. We will tell you at least 14 days before a renewal at a new price.
Renewal
Licences renew automatically each year so that updates and support carry on. Before each renewal, we email you the date and the price, at least 14 days in advance.
You can turn renewal off at any time, from the link in your receipt or by emailing us. Your licence then runs to the end of the year you have paid for. It does not stop early.
Changing your mind
Every payment, including renewals, comes with a 30-day money-back guarantee. The refund policy explains how it works and how it fits with your legal right to cancel.
What A11yMate can and cannot do
A11yMate finds accessibility problems, explains them and helps you fix them. Please read this part carefully:
- Automated checks find only some problems. Typically that is a third to a half of the issues that affect disabled people. Some things need a person to judge, and A11yMate marks those for you.
- A good score is not a compliance certificate. A11yMate does not guarantee that a site meets WCAG, the Equality Act 2010, the European Accessibility Act, the ADA or any other standard or law. It is not legal advice.
- Your site remains your responsibility. Test with a keyboard and a screen reader, and with disabled people where you can.
- Safe Fixes change the pages your site sends to visitors. They never change your content in the database. Check your site after you turn one on, and turn it off if it does not suit your theme.
Our responsibility to you
If you are a consumer, the law protects you. Under the Consumer Rights Act 2015, digital content must be of satisfactory quality, fit for purpose and as described. If it is not, you are entitled to a repair or a replacement or, if we cannot put it right, some or all of your money back. Nothing in these terms takes those rights away.
If you are buying for a business, our total liability to you for anything to do with A11yMate is limited to what you paid us in the 12 months before the claim. We are not liable for indirect losses or lost profits. We are also not liable for lost data, so please keep backups of your site.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
Support
Support is by email to hello@a11ymate.co.uk. We aim to reply within 2 working days, and Agency licences are answered first. Support covers installing A11yMate, understanding its results and using its features. It does not include fixing the problems A11yMate finds on your site, though OakFox can quote for that.
If a licence is misused
Examples of misuse are using a licence on more sites than it covers, or sharing or reselling keys. If that happens, we will tell you and give you a fair chance to put it right before we end the licence.
Changes to these terms
We may update these terms. The version in place when you buy or renew applies to that year. If a change affects you, we will tell you before your next renewal.
Law
These terms are governed by the law of England and Wales. If you are a consumer who lives in Scotland or Northern Ireland, you can also bring a claim in your local courts. If you live in the EU, you keep the protections your own country's law gives you.
